THE OFFICIAL DISPATCH NO. 410/CVL-TTLD  OF THE MINISTRY OF LABOUR, INVALIDS AND SOCIAL AFFAIRS OF VIETNAM, EMPLOYMENT DEPARTMENT OF VIETNAM ON THE IMPLEMENTATION OF POLICIES ON RENT SUPPORT FOR EMPLOYEES ACCORDING TO DECISION NO. 08/2022/QD-TTG OF THE PRIME MINISTER OF VIETNAM

Effective date: June 08, 2022  

Main contents: 

The time to request support: Based on the provision of Article 4 of Decision No. 08/2022/QD-TTg, the period of time for support starts from February 2022. 

The starting time of the employment contract: 

  • Based on Clause 2, Article 8 of Decision No. 08/2022/QD-TTg, he/she has an employment contract entered into and performed before April 1, 2022  but expired on March 31, 2022, continues to sign a fixed-term employment contract for the second time from April 1, 2022, the dossiers and procedures shall be applied according to provisions of Chapter II of Decision No. 08/2022/QD-TTg; the employees, the enterprises shall record the starting time of the employment contract in Form No. 01, Form No. 02 attached with Decision No. 08/2022/QD-TTg as the starting time of the employment contract, which was signed and performed before April 1, 2022. 
  • Based on Clause 2, Article 8 of Decision No. 08/2022/QD-TTg, he/she performs a training contract or a probationary contract in February, March 2022, and until April 2022, the fixed-term employment contract for a duration of 01 month or more is signed, the support level, application dossier, procedures shall comply with the provisions of Chapter III – Support for employees returning to the labor market.  

 

Duration of time living on a room/house for rent: 

  • Clause 1, Article 4 of Decision No. 08/2022/QD-TTg stipulates the duration of time living on a room/house for rent; in which there is no regulation on the time of starting to rent before February 1, 2022 or after March 28, 2022. Therefore, employees living on a room/house for rent in the period of time from February 01, 2022 to June 30, 2022 are eligible for support. 
  • Clause 1, Article 8 of Decision No. 08/2022/QD-TTg stipulates the duration of time living on a room/house for rent; in which there is no regulation on the time of starting to rent before April 1, 2022 or after March 28, 2022. Therefore, employees living on a room/house for rent in the period of time from April 01, 2022 to June 30, 2022 are eligible for support. 

Article 5, Article 9 of Decision No. 08/2022/QD-TTg stipulate the level, duration of support and monthly payment method. Therefore, the Department of Labor – War Invalids and Social Affairs is requested to guide employees and businesses to prepare dossiers for rent support for the preceding month or for the combination of the previous 2 or 3 months (for example, in June, make a request for May; or in June,  make a request  for May, April, and March); and at the same time, guide the district-level People’s Committee to base on the actual applications of the enterprises to appraise and approve to make the monthly payment to employees.
